District 3 Issues - Updated Jan 8, 2008

This is a summary of select zoning issues introduced during the 2008 County Zoning Map Process (CZMP.) The goal is to inform the community of the issues that may affect them, what the results may be if the requests are successful and most importantly, to help the community remain vigilant! This is not necessarily an objective summary, but the issues outlined here were filed as part of the CZMP process for 2008.

(ref P.33 of ARC screenshot) The 25 acre is listed as a "reserved parcel" and is part of an even larger parcel known as "Warren Property." The balance of this larger parcel appears to have been subdivided into a 3, 12 & 13 acre parcel in the past (ref. P208, P.209 of ARC screenshot).

Requesting rezoning of  Shelley's Fields development site from RC5 & RC2 to RC8.

Submitted in conjunction with an appeal to the approval of the  amended development plan. Original plan for sports complex was greatly reduced in scope after settlement with Freeland Community Association. If the appeal or the rezoning request were successful, a pyrrhic victory may result, negating the covenants and restrictions placed on the RC2 portion of the property and opening the door to another institutional proposal. A church or school could be developed by right, regardless of the zoning, and the environmental impact mitigations and use limitations achieved by the FCA settlement would be null and void. The property is currently owned by the developer, not a farmer,  making this outcome a distinct possibility, should the protestants be successful.

Requesting downzoning of  43.1 acres from RC4 to RC6.

This property was the subject of a Community Input Meeting on a proposed development plan in 2006. The plan never proceeded beyond that point and there were many environmental issues with the property. The RC-6 zoning classification is rarely used - only the most environmentally sensitive properties are considered for this classification, which generally allows only one house per 5 acres of the area of the lot deemed suitable for development. This means that no slopes or conservation areas can be used in the calculation of density. Any future development plan would be of a greatly reduced scope under this zoning.
