Submitted in conjunction with an appeal to the
approval of the amended development plan. Original plan for sports
complex was greatly reduced in scope after settlement with Freeland
Community Association. If the appeal or the rezoning request were successful,
a pyrrhic victory may result, negating the covenants and restrictions placed on the RC2 portion of the
property and opening the door to another institutional proposal. A church or
school could be developed by right, regardless of the zoning, and the
environmental impact mitigations and use limitations achieved by the FCA
settlement would be null and void. The property is currently owned by the
developer, not a farmer, making this outcome a distinct possibility, should the
protestants be successful.
